About these terms
These Terms of Use ("Terms") apply to your use of raleighgaragedoorsos.com (the "Site") and the referral service offered through it. "We," "us" and "our" mean LM Ventures LLC, a Minnesota limited liability company. Raleigh Garage Door SOS is an assumed name of LM Ventures LLC. By using the Site or submitting a request, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the Site.
What we do, and what we don't
- Raleigh Garage Door SOS is a referral service. We connect homeowners in the Raleigh-Durham area with independent garage door companies.
- We are not a garage door contractor. We don't inspect, repair, install or sell garage doors, openers or parts, and we don't employ, dispatch or supervise technicians.
- Partner companies are independent businesses, not our employees, agents or franchisees. They set their own prices, schedules, warranties and terms.
- Any estimate, contract, payment, warranty or dispute about work is between you and the company you hire. We are not a party to it.
- We don't guarantee that a company will be available, that it will contact you within any particular time, or that any company's work, prices, licensing or insurance will meet your expectations.
- Before you hire anyone, we suggest getting a written estimate, asking about warranties, and confirming the company is insured.
- You're free to hire the company we connect you with, a different company, or no one. Submitting a request doesn't obligate you to buy anything.
- Our service is free for homeowners.
Emergencies and safety
The Site is not an emergency service. If anyone is hurt or trapped, or if there's a fire, a gas smell or any other immediate danger, call 911.
Garage door springs and cables are under high tension and can cause serious injury. Information on the Site is general and for education only. It isn't professional advice about your particular door, and it isn't a substitute for an inspection by a qualified technician. Don't attempt repairs you aren't trained and equipped to do safely.
Cost information
Price ranges on the Site come from published third-party sources, which are named where the figures appear. They are general estimates, not quotes or offers from us or from any company. What you actually pay depends on your door, the parts needed and the company you hire.
Your responsibilities
To use the Site, you agree that:
- you are at least 18 years old and able to agree to these Terms
- you own the property, or you're authorized to arrange service there
- the information you give is accurate, and the phone number you enter is yours or one you're authorized to use. Don't submit a request for someone else without their permission.
- if you give up or change the phone number you entered, you'll reply STOP to any texts or let us know
Photos. If you upload a photo, you confirm that you took it or have the right to share it. You give us permission to store it, use it, and share it with the partner company to handle your request. Don't upload photos of people without their permission, or anything unlawful or offensive.
Don't misuse the Site. Don't submit false, spam or prank requests. Don't use bots, scrapers or other automated tools to access the Site or submit forms. Don't interfere with the Site's security or operation, and don't use the Site for anything unlawful.
Calls and text messages
- If you check the consent box on the request form, you agree to receive calls and text messages from the partner company described there and from Raleigh Garage Door SOS about your request, as described next to the box. That can include calls and texts made with an automatic telephone dialing system, and calls that use a prerecorded or artificial voice. Checking the box is optional and is not a condition of any purchase.
- Message frequency varies. Message and data rates may apply.
- Reply STOP to opt out of texts from whoever sent them, or HELP for help.
- Wireless carriers are not liable for delayed or undelivered messages.
- Our Privacy Policy explains how we handle your information.
Contractor inquiries
Sending an inquiry through the contractor form doesn't create a partnership, agreement or obligation of any kind. Any partner relationship is covered by a separate written agreement.
Our content and name
The Site's text, design, logo and graphics belong to us or to the people who licensed them to us. You may view the Site, share links to it, and print pages for your own personal, non-commercial use. Don't copy, republish or sell the Site's content without our written permission.
Raleigh Garage Door SOS is an independent business. It is not affiliated with, endorsed by or operated by the City of Raleigh, any other city or county, or any government agency.
Links to other websites
The Site links to other websites, such as the sources of the cost figures. We don't control those sites and aren't responsible for their content or practices.
Disclaimers
The Site and the referral service are provided "as is" and "as available." To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We don't promise that the Site will be error-free or always available.
We are not responsible for the acts, omissions, work, products, prices or conduct of any partner company or other third party.
Limitation of liability
To the fullest extent the law allows, we will not be liable for any indirect, incidental, special, consequential or punitive damages, for lost profits, or for any loss or damage arising from work performed by a company you hire, in each case arising out of or related to the Site or the referral service. Our total liability for any claim related to the Site or the referral service is limited to one hundred U.S. dollars ($100).
Some places don't allow certain warranty disclaimers or liability limits, so some of the above may not apply to you. Nothing in these Terms limits any liability that can't be limited under applicable law.
Indemnity
You agree to indemnify and hold us harmless from claims, losses and expenses (including reasonable attorneys' fees) arising from your misuse of the Site, your violation of these Terms, or content you submit, such as photos.
Governing law and disputes
These Terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-law rules. Any dispute about these Terms, the Site or the referral service will be brought only in the state or federal courts located in North Carolina, and you and we consent to the personal jurisdiction of those courts.
If you have a concern, please contact us first so we can try to resolve it informally.
Changes to the Site or these Terms
We may change, suspend or stop any part of the Site or the referral service at any time. We may also update these Terms. When we do, we'll post the new version here. Changes apply from the time they're posted. If you keep using the Site after that, you accept the updated Terms.
General
These Terms and the Privacy Policy are the whole agreement between you and us about the Site. If any part of these Terms can't be enforced, the rest stays in effect. If we don't enforce a provision right away, that doesn't waive it. You may not transfer your rights under these Terms. We may transfer ours as part of a sale, merger or transfer of the business.
